LawCare -SMS Privacy Policy

This SMS Privacy Policy explains how we collect, use, and protect your information in connection with SMS communications. We may update this policy from time to time. Updates will be posted on this page with revised effective dates as applicable.

1. DATA SHARING

Mobile opt-in data and consent will not be shared with any third parties.

We do NOT sell, rent, or share your mobile number or SMS consent data with third parties. We may disclose information only as required to comply with applicable laws, regulations or legal processes including but not limited to the Pennsylvania Rules of Professional Conduct.

2. INFORMATION WE COLLECT

When you opt- in to receive SMS messages we have access to and we may collect:

a. Your phone number

b. Your name

c. Communication preferences

d. Message content

e. Message delivery and interaction date

f. Consent records

3. PRIVILEDGED INFORMATION

Any communications you provide to us using SMS will be protected by Attorney Client Privilege. However, if you share this information with a third party, it is no longer protected by privilege. In addition, if a non-client uses the SMS system, that information also is not protected by Attorney Client Privilege. Please be sure to keep your communications safe and secure.

4. HOW WE USE YOUR INFORMATION

We may use your information to:

a. Communicate with you regarding your legal matter, including case updates and requests for information

b. Send appointment reminders and scheduling communications

c. Provide billing notifications and payment-related communications

d. Respond to your inquiries and provide client support

e. Improve our services and communication processes

We may disclose information to third parties only with your expressed permission as required to comply with applicable laws, regulations or legal processes including but not limited to the Pennsylvania Rules of Professional Conduct.

All SMS communications will be consistent with these purposes.

5. DATA SECURITY

We implement reasonable administrative, technical and physical safeguards to protect your information from unauthorized access, disclosure or misuse.

We utilize MyCase as our client management system and client portal.

6. DATA RETENTION

LawCare retains SMS-related personal information only for as long as necessary to fulfill the purposes outlined in this SMS Privacy Policy, including:

a. Providing legal services and client communications

b. Maintaining records of consent, or records related to legal representation for compliance with applicable laws and regulations

c. Resolving disputes and enforcing our agreements.

We maintain records of SMS consent in accordance with applicable telecommunications and legal compliance requirements.

SMS message content, phone numbers, and related communication records may be retained in accordance with the firm’s standard record retention practices and applicable legal and ethical obligations governing attorneys and client record retention. Please review your fee agreement for additional information concerning the handling of your file including SMS messaging information.

When such information is no longer required, it will be securely deleted or anonymized in a manner designed to prevent unauthorized access or use. Any data removal or destruction of information is in compliance with the Commonwealth of Pennsylvania.

7. YOUR RIGHTS AND CHOICES

You have the right to control how your mobile information is used in connection with SMS communications from LawCare.

ACCESS & CORRECTION:

You may request access to or correction of your contact information by contacting the firm using the contact information below. If choices or contact information changes, contact us immediately at the information below.

DATA PREFERENCES:

You may request that we limit or modify how we use your information, including requesting alternative methods of communication where appropriate. Any such request will be considered in accordance with our legal and ethical obligations, including applicable record retention requirements.
